Bennett Jones privacy notice provides information we or representative offices and any 3rd party providers collect, use, secure, transfer and share your information. Bennett Jones Partnership Ltd is a Residential and Commercial Estate Agent and Letting Agent. We also undertake Professional Valuation work. Our office address is 31 Parsonage Street, Dursley, Gloucestershire, GL11 4BW. We also have marketing offices in 6 The Market Place, Berkeley, GL13 9BB and 46 Long Street, Wotton under Edge, GL12 7BT.

 

Information Collected

 

Bennett Jones collects information relevant to the services it provides, whether it is as a vendor, purchaser, landlord, tenant or for a professional valuation. These details may be used for the desired purpose but may also be shared between the sales lettings and professional departments if there is a crossover of services. We will only pass on those details to third parties including Solicitors, Financial advisors, referencing agencies and contractors, subject to applicants agreement,  if required during the sales or lettings transaction.

 

The details required and who they may be passed onto:

 

Sales

 

For marketing purposes; details of name, address, telephone number and email address will be required, in order to keep applicants updated with properties that meet their requirements.

 

Solicitors; at the point of instruction of a sale once an offer has been accepted.

 

Third Party Selling agents; whilst confirming details of a chain.

 

Financial advisor; to check an applicant’s financial ability to proceed once an offer is made.

Our recommended financial advisor Philip Priest of Kingsbridge Financial - Only at your request.

 

When selling a property; Energy Assessor Richard Wood - for the purposes of arranging an Energy report.

 

We are required under Anti Money Laundering Regulations to collect details of ID and if an individual is purchasing finance prior to entering into a business relationship.

These details will be kept for 7 years after completion of a sale.  You have the right to be removed from our mailing list and your details forgotten until such a time that you have viewed a property after this we will need to keep them for reasonable business requirements.

Lettings

 

Prospective Tenants; personal details will be collected and used for credit and general referencing purposes, if an individual applies to rent a property through ourselves. These details may include salary, employer details, credit history, benefits, other sources of income and previous landlord details. In addition, under the Right to Rent Act we will be required to take details of your identity including photographic evidence and any relevant work permits and visas. Such details will be held for up to 7 years after the tenancy ends. These details are used by referencing agency The Lettings Hub and will be held for future contact during the tenancy and will be held for 7 years after the end of the tenancy.

 

Such information will generally be collected directly via the use of any of our standard forms, over the internet, via email, in our branches or through a telephone conversation with you or via portals including Rightmove, Zoopla, On the Market, Vebra, their third party internet portals and The Lettings Hub. 

 

Once you become a tenant of a property your details may be passed on to an approved contractor for the purposes of arranging access for repairs and maintenance. A list of contractors is available on request.

Privacy Notice

 

This Privacy Notice specifies your ability, to opt out or limit the usage of the information collected except where it is required for contractual purposes

 

We will collect, use and hold your information for the following purposes:

 

-Assessing applications to rent or purchase. Process payments / transactions including: Accounting, authorisation, auditing, billing, reconciliation, collection, complaints, enquiries, credit checks and related dispute resolution activities

-Protecting against and preventing fraud, unauthorised transactions, money laundering (please see below), tax evasion, claims, other liabilities and managing risk exposure and agent compliance and security of business processes.

-Anti-Money Laundering. In addition to help you with a property related service we have to comply with certain regulations for example the “Money Laundering, Terrorist Financing and Transferring of Funds (Information on the Payer) Regulations 2017. We will require two separate Identification documents one primary and one secondary document even if it appears on both lists. The information may be required at various stages of the process depending whether you are purchasing or selling.

-We reserve the right to employ third party electronic verification for the purpose of verifying identity through our provider Veriphy. This search will not affect your credit rating.

-Bennett Jones Partnership Ltd. processes your information for the following reasons: Lawful processing, Performance of a contract and Legitimate interests.

-Consent: where we process information under consent we will seek your clear and unambiguous consent prior to processing your data.

Information we share

 

We do not disclose personal information we collect about you, except as described in this Privacy Notice or as indicated via the consent process at the time the data

is collected. If we share this information we collect then we contractually require these service providers to safeguard the privacy and security of personal information they process on our behalf.

When completing an application form with the Lettings Hub you will need to give permission for data to be obtained and shared with us.

 

Protecting Personal Information

 

The security of your personal information is very important and we will ensure that we maintain all safeguards to protect the personal information you provide. Bennett Jones retains information only for as long as it is necessary. We will destroy this information after this time.  Any breach will be reported to you and to the ICO within 72 hours of the breach taking place.

You have the right to access your information and what personal information we collect and how we communicate with you. You also have the right to update and correct inaccuracies in your personal information.
